Reservation Terms and Conditions (hereinafter referred to as the "Terms")
These terms govern the relationship between TravelManiac s.r.o., a company established under the laws of the Czech Republic, with registration number 21188688, registered at Lublaňská 267/12, Prague 2, Czech Republic (hereinafter referred to as the "Company") and the user (hereinafter referred to as the "User"). By making a reservation, the User agrees to these Terms. Consent is deemed received by the Company at the moment the User clicks the "BOOK" button.
Terms and Definitions
Reservation means a combination of actions by the User resulting in the generation and submission of a preliminary hotel booking after accepting these Terms.
Voucher means an electronic confirmation of the Reservation sent to the User's email address provided during the Reservation process. This confirmation includes reservation details, specifically (if applicable): hotel name, location (address), reservation date, expected arrival and departure dates, room category, bed type, deposit (if any), cancellation policies, penalty start date, User's liability (penalties) for non-compliance with cancellation and change policies established by the hotel, liability for no-shows, and any other related information as deemed necessary by the hotel.
Personal Account means a section of the website for registered users containing tools for managing the reservation.
No-show means the User's failure to arrive and check in at the hotel at the time specified in the voucher or at another time duly confirmed in writing by the hotel.
Room means a room in a hotel (possibly a house (cottage) and its parts, apartments, beds/beds available in shared spaces, etc.), which is the subject of the Reservation.
Hotel means any complex of premises (hotel, guesthouse, spa resort, resort, hostel, etc.) in which rooms are available for reservation; and according to the context, it will mean a legal entity or individual who owns or operates the hotel.
Cancellation Policy means the cancellation and change policies set by the hotels, including liability (penalties) for non-compliance with these policies by the User and no-show fees. The cancellation policy and penalties for cancellation or change of the Reservation, including liability for the User's no-show, will be communicated to the User during the reservation and payment process and will be stated in the voucher.
User means a competent natural person over the age of 18 who has accepted these Terms and is legally authorized to make a Reservation through the service and pay for it.
Service means a multifunctional information technology online hotel booking platform available on the website, including versions and adaptations intended for mobile devices. The User is granted access to the Service under the conditions of a free, simple, and non-exclusive license.
Website means the public resource on the Internet located at: www.travelmaniac.org.
Hotel Services mean hotel accommodation services including other services stated in the voucher, excluding any additional services provided by the hotel to the User upon their request, which are not directly specified in the voucher.
General Provisions
The Company has a proper license to use the Service for commercial purposes and has the right to publish information about hotels and hotel services, as well as enable users to make reservations and pay for them in accordance with these Terms. The Company is responsible to the User under the conditions, to the extent, and in the manner set out in these Terms.
The Company, in accordance with these Terms, only provides the User with free access to the hotel database and enables the User to make a reservation and pay for it, as well as provides access to customer support. The Company does not charge the User any fees or commissions in connection with making a reservation and paying for it.
By confirming the reservation by the hotel, the User enters into a legal relationship with the hotel, which will provide hotel services to the User. The Company does not participate in the relationships between the User and the hotel, including in relation to the provision of hotel services, and has no obligations towards the User regarding hotel services, nor bears any responsibility except in cases specified by these Terms. The Company's obligations towards the User are limited solely to providing access to the hotel database and ensuring the technical capability to make and pay for a reservation. The Company also undertakes to refund the reservation amount in the manner and in cases specified by these Terms.
The basic conditions of the reservation, such as the possibility of making reservation changes, cancellation of the reservation, the application of penalties in case of cancellation or change of the reservation, consequences of the User's no-show, are determined by the hotel's policies valid at the time of the reservation and will be stated in the voucher.
By making a reservation, the User confirms that they have read and agree with all reservation conditions, as well as with the wording of these Terms effective at the time of the reservation.
Payment for the Reservation
The User will pay for the reservation directly on the website using a bank card or other electronic payment method or pay for the reservation directly at the hotel during check-in or check-out. To guarantee the reservation payment at the hotel, the hotel may require the User to provide bank card details during check-in and may refuse accommodation in case of unsuccessful validation of the bank card or insufficient funds on the card to cover the accommodation costs and other additional services.
By providing bank card details during the reservation process, the User confirms that they have read and agree with the reservation conditions (including changes/cancellation policies) of the selected hotel and agree to comply with them. During the reservation, the User is not entitled to use payment card details that do not belong to them, except in cases where the User has obtained the cardholder's consent to use the card details for payment of the reservation. By using bank card details for the purpose of making a reservation on the website, the User confirms and guarantees that they are the lawful holder of such a bank card. When using a card that does not belong to them, the User confirms that they have received the necessary consent from the lawful owner of the bank card to use it for the purpose of guaranteeing or paying for the reservation.
The bank cardholder is in any case responsible for the security of their bank card details and for all actions performed with these details. The Company is not liable to the hotel or the cardholder for unauthorized use of bank card details by any third party for the purpose of guaranteeing or paying for reservations on the website.
When using a bank card, all transmitted data is protected using modern security technologies on the websites used by the User. The Company also guarantees the confidentiality and security of the information provided by the User during registration and the reservation process.
Cancellation of the reservation (in whole or in part), changes to the reservation, as well as the User's no-show at the check-in (check-in) at the hotel, may be subject to charges and penalties according to the hotel's policies valid at the time of the reservation, which are published during the reservation process and stated in the voucher. The User is obliged to pay all fees and penalties incurred in accordance with the cancellation, change of reservation, or no-show policies, as well as any additional services provided by the hotel at the User's request.
Changes and cancellations of the reservation on the website may be possible after receiving the voucher only if such changes are in accordance with the hotel's policies valid at the time of the reservation. In such a case, the User may cancel or change the reservation through their personal account on the website in accordance with these policies.
