Introduction

These Terms & Conditions apply to the use of the TravelManiac LLC ("TravelManiac", "we", "us", "our") website, mobile applications, tools, and all related platforms (collectively, the "Platform"). By accessing or using the Platform, the Customer ("you", "your") confirms that they have read, understood, and accepted these Terms & Conditions.

TravelManiac provides an online platform for searching, comparing, and booking travel-related services (the "Services") provided by independent third-party suppliers ("Service Providers"). The Platform operates in part using the TBO API.

Role of TravelManiac

TravelManiac is an intermediary. We do not own, control, or provide accommodations, flights, tours, transfers, activities, insurance, SIM cards, car rentals, or any other travel services. When you make a booking, you enter into a direct contractual relationship with the relevant Service Provider. Their terms apply in addition to ours. TravelManiac is not responsible for the quality, accuracy, safety, legality, cancellations, availability, or performance of services offered by Service Providers.

Platform Content and Information Accuracy

All information provided on the Platform, including availability, descriptions, photos, amenities, policies, and prices, originates from Service Providers or external systems, including TBO. We do not verify this information and cannot guarantee accuracy. Service Providers remain responsible for the correctness and completeness of all content related to their services.

Booking Process and Confirmation

A booking is confirmed only when TravelManiac sends a confirmation email or voucher. Due to system delays, outages, price fluctuations, or availability changes, we reserve the right to cancel or adjust bookings. In such cases, we will notify you and offer a full refund or an alternative option.

Customer Responsibilities

You are responsible for ensuring that all information you provide is accurate, up to date, and complete. You must comply with all travel requirements, visa rules, passport validity regulations, health restrictions, provider policies, and local laws. You must review and accept the Service Provider's terms before completing a booking.

Prices, Taxes, and Currency

Displayed prices may fluctuate due to exchange rates, availability, or provider changes. Taxes, fees, or charges may vary by region. TravelManiac may display prices in multiple currencies, but your payment may be processed in a different currency supported by Stripe or the Service Provider. Currency differences, bank fees, or conversion fees are your responsibility.

Payment Processing

Payments are processed securely through third-party providers such as Stripe. TravelManiac does not store or directly process full card details. By making a payment, you agree to Stripe's terms and privacy policy. Stripe may conduct fraud checks, apply authorization holds, or verify card information. Service fees, handling fees, or processing fees may apply and will be disclosed before payment.

Payment Models

TravelManiac may use either the agency model (you pay the Service Provider) or the merchant model (you pay TravelManiac). The applicable model will be displayed during checkout.

Card Verification and Fraud Screening

We and Stripe reserve the right to: verify card validity, pre-authorize funds, charge a small test amount, request identity documents. Failure to comply may result in cancellation.

Amendments and Cancellations

Changes or cancellations are governed by the Service Provider's policies. Many bookings are non-refundable. If changes are allowed, the Service Provider may impose fees. TravelManiac will assist in submitting requests but cannot override provider policies.

No-Show

If you fail to appear or check in ("no-show"), the booking is typically non-refundable.

Refunds

Refunds are issued only after the Service Provider approves the refund and transfers refundable amounts to TravelManiac. Refunds are issued to the original payment method through Stripe. Refundable amounts may be reduced by provider fees, non-refundable booking components, Stripe fees, exchange rate differences, or TravelManiac service fees. If a provider denies a refund, TravelManiac cannot refund you.

Chargebacks

You agree to contact TravelManiac before initiating a chargeback. Fraudulent or unjustified chargebacks may result in claim recovery actions, account suspension, or cancellation of bookings.

Overbooking and Relocation

If a Service Provider cannot deliver the booked service (including cases of overbooking or closure), the provider is responsible for offering alternatives or refunds. TravelManiac will assist but is not liable for relocation differences or additional costs.

Customer Behavior

Service Providers may refuse service if you act fraudulently, dangerously, unlawfully, or in violation of their rules. No refunds will be granted in such cases.

Customer Representations and Warranties

You represent and warrant that you: are legally able to enter contracts, will not use the Platform for unlawful purposes, will not make speculative, false, or fraudulent bookings, will comply with these Terms and Provider policies.

Indemnity for Fraud or Misuse

You agree to indemnify TravelManiac against all losses arising from fraudulent transactions, misuse of the Platform, unauthorized card use, or violation of these Terms.

Liability

To the fullest extent permitted by law: TravelManiac is not liable for indirect or consequential damages, including lost profits, missed flights, or emotional distress. TravelManiac is not liable for delays, cancellations, or actions of Service Providers. The total cumulative liability of TravelManiac is limited to the amount you paid for the booking giving rise to the claim.

Force Majeure

TravelManiac is not liable for failures caused by events beyond our control, including pandemics, natural disasters, strikes, government restrictions, war, system outages, or provider insolvency.

Platform Use Restrictions

You may not: scrape, index, deep-link, or reproduce Platform content, use automated systems to access data, attempt to reverse-engineer the Platform, misuse the booking engine or availability system.

User-Generated Content

By submitting reviews or content, you grant TravelManiac a perpetual, worldwide, royalty-free license to use and distribute such content. We may remove unlawful, offensive, or misleading content.

Account Management

You must keep your login credentials confidential. You are responsible for all activity in your account.

Assignment

TravelManiac may assign these Terms to affiliates or successors. You may not assign rights without written permission.

Complaints

If you encounter an issue, you must contact the Service Provider immediately and obtain written evidence. Notify TravelManiac within 14 days. Failure to follow this process may reduce your rights.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, USA. Disputes must be brought exclusively before Wyoming courts unless mandatory laws require otherwise.

Class Action Waiver

To the extent permitted by law, you agree not to participate in class, collective, or representative actions.

Changes to Terms

TravelManiac may modify these Terms at any time. Continued use of the Platform indicates acceptance.
